Potential liability issues for consulting, independent, and moonlighting industrial hygienist (IH) offering services have become significant. Claims against professional liability policies and lawsuits filed against IHs have been on the rise. Based on past professional liability claims the IH must ask: What is the standard of care for the services offered by an industrial hygienist? Is this standard different for certified industrial hygienist (CIH), IHs, and non-IHs practicing in traditional IH areas? When clients request only certain IH-recommended services due to a limited budget does this place the IH at higher risk? This mock trial will address these and other related
questions. The trial will focus on a CIH being sued by his client for negligence in a water damage investigation - mold remediation case. Experienced attorneys will cross-examine the defendant, plaintiff and expert witnesses. Roundtable attendees will serve as jurors and vote on a verdict. Following the trial, key legal issues will be discussed, along with related questions (standard of care and liability).
